The Transformation of American Law, 1870-1960: The Crisis of Legal Orthodoxy

The Transformation of American Law, 1870-1960: The Crisis of Legal Orthodoxy (Oxford Paperbacks)

From Library Journal

For anyone seriously interested in studying American legal history, this insightful and persuasive account of the development of American law from the late 19th century to the mid-20th century is required reading. Comparing and contrasting Progressive Legal Thought with its predecessor, Classical Legal Thought, Horwitz clearly proves the impossibility of understanding the development of the American legal system separate from the broader cultural context, domestically and internationally. Building on his equally impressive earlier volume ( The Transformation of American Law , 1780-1860 , LJ 2/15/77), Horwitz provides lucid and challenging material on critical figures and events in the evolution of American law, such as Oliver Wendell Holmes, the Lochner decision, and Critical Legal Studies. Not everyone will agree with some of the conclusions, but this excellent work cannot be ignored. Especially recommended for upper-level graduate libraries. - Step

‘. . . this book can be warmly recommended for its topicality, as well as its provocative thesis and rich detail. ‘ The Round Table

“Lauren Benton’s important new book deserves a careful reading from both legal historians and historians of imperialism. . . . Benton is to be congratulated for these insights, and for bringing such far-flung, complex subjects together into a compelling whole. Naturally, in so doing, she reaches conclusions with which not everyone will be comfortable, but that is what good history does. ” H-Net: Humanities and Social Sciences Online”Lauren Benton has written an original and fascinating book. . . a major contribution to the fields of history and law. ” Canadian Journal of Law and Society”This valuable compilation of contexts, examples, and analyses constitutes a fascinating and accessible read for scholars across disciplines. . . . Benton’s research is impeccable in its careful conceptualization and the breadth and

White by Law: The Legal Construction of Race

White by Law: The Legal Construction of Race (Critical America Series)

From Publishers Weekly

In this study, narrowly academic yet intriguing, Lopez, who teaches law at the University of Wisconsin, examines early-20th-century cases in which courts sought to determine who qualified as white for the purposes of citizenship and naturalization. His conclusion: whiteness is “a complex, falsely homogenizing term. ” For example, he shows how courts issued contradictory decisions regarding the whiteness of groups such as Syrians, Armenians and Asian Indians; some followed scientific evidence, while most ultimately relied on “common knowledge,” thus finding many reasons?including culture and political sophistication?to reject foreigners who might be Caucasian. This leads the author to argue, a bit thinly, that whites must pursue a “self-deconstructive” race consciousness to pursue racial justice. Thus, whites must recognize the racial aspects of their privileged identity and daily engage in “choosing against Whiteness”; one example would be to resis
